As a federally recognized tribe, the
Fond du Lac Band has Treatment as a State status (TAS) and has the
right to comment and to be consulted on any Title 5 Permitting
Actions within 50 miles of the reservation and the Ceded
Territories.
Companies must develop Environmental
Impact Statements for new projects or for significant changes or
expansions to existing operations and submit them to State Agencies.
The Fond du Lac Air Program reviews
permits for local sources of air pollutants and sends the comments
in before these permits are finalized. Permits are issued by the
Minnesota Pollution Control Agency, the Wisconsin Department of
Natural Resources or the EPA on tribal lands.
Personnel read the permits to see if
emissions limits will be met and if the right types of control
equipment will be used. Essentially the air program acts as an extra
set of reviewers that augment state efforts.
Some projects recently reviewed
include several new and existing mining projects, forest products
manufacturing facilities, pipelines, and electric power plants.

Regulatory Review
The federal or state government will
propose new or revised environmental rules. The states may have
stricter laws than the federal government. If the Clean Air Act has
a modification, it is announced through the Federal Register.
The Fond du Lac Air Program has
commented on numerous regulations including the New Source Review (NSR)
and Prevention of Significant Deterioration (PSD), the National
Ambient Air Quality Standard (NAAQS) for Lead (Pb), Regulating
Greenhouse Gas Emissions, and Geologic Sequestration of Carbon
Dioxide.
